Can a Recalled Philips CPAP Machine Be Repaired?

February 20, 2023 In Philips CPAP Recall

Philips recently issued a recall for certain Continuous Positive Airway Pressure (CPAP) machines due to potential health risks, causing concern among those who rely on the device for treatment. The recall has left individuals wondering about their options and whether a recalled Philips CPAP machine can be repaired.

In some cases, the answer is yes. A recalled Philips CPAP machine can be repaired, but it is important to note that not all recalled devices are eligible for the repair program offered by Philips. Instead, you might have to request a replacement.

However, Philips will not always pay for the cost of a new CPAP device. In these cases, you may want to file a lawsuit against the manufacturer to recover compensation for the cost of a new device, in addition to other damages like medical expenses.

Why Were Philips CPAP Machines Recalled?

In June 2021, Philips recalled certain ventilators, bilevel positive airway pressure (BiPAP) machines, and CPAP devices due to potential health risks. The recall was issued by the Food and Drug Administration (FDA) after it was determined that the polyester-based polyurethane (PE-PUR) foam used in these devices could break down and release black pieces or toxic chemicals into the user’s airway.

These particles and chemicals can cause serious health issues, such as:

  • Headaches
  • Dizziness
  • Irritation to the skin, eyes, nose, and respiratory tract
  • Inflammatory response
  • Asthma
  • Nausea and vomiting
  • Toxicity and risk of cancer to organs such as kidneys and the liver

It is important to take the recall of these Philips ventilators, BiPAP machines, and CPAP machines seriously. If you have experienced any symptoms or health issues related to the use of a recalled device, seek medical attention immediately. Then, contact an attorney representing Philips CPAP lawsuits to discuss your legal options.

Which CPAP Machines Were Part of the Recall?

The following devices were part of the Philips CPAP recall:

  • DreamStation ASV
  • SystemOne (Q-Series)
  • Trilogy 100 (ventilator)
  • Dorma 500
  • A-Series BiPAP A40 (ventilator)
  • REMstar SE Auto
  • E30
  • A-Series BiPAP Hybrid A30
  • C-Series S/T and AVAPS
  • DreamStation Go
  • OmniLab Advanced+
  • C-Series ASV (ventilator)
  • A-Series BiPAP A30
  • DreamStation
  • Garbin Plus, Aeris, LifeVent (ventilator)
  • A-Series BiPAP V30 Auto (ventilator)
  • DreamStation ST, AVAPS
  • Trilogy 200 (ventilator)
  • Dorma 400

In addition, certain Trilogy Evo ventilators distributed from April 15, 2021 to May 24, 2021 with specific serial numbers were part of the recall.

Repair Options for Recalled Philips CPAP Devices

If you own one of the recalled Philips CPAP devices, it’s important to take action to minimize the potential health risks associated with using the device. Philips is offering repair options for affected devices to reduce the potential exposure to the PE-PUR foam, but only certain recalled machines are eligible for the program.

The following Philips CPAP machines may be repaired:

  • Philips DreamStation CPAP; Pro, Auto (all configurations)
  • Philips DreamStation BiPAP; Pro, Auto (all configurations)
  • Philips DreamStation ST, ASV, AVAPS (all configurations)

Philips received authorization from the FDA for the repair of these affected devices, which involves replacing the PE-PUR sound abatement foam with a new material. However, Philips has not yet provided any information about repairing other recalled CPAP, BiPAP, and mechanical ventilators. More devices may be added as the company continues to communicate with the FDA.

Replacement Options for Recalled Philips CPAP Devices

In addition to the repair program, Philips is also replacing certain affected first-generation DreamStation CPAP devices in the US with DreamStation 2 CPAP devices. Users and caregivers can register for this program on Philips’ website. If you own another device affected by the recall, you may need to purchase a new machine out of your pocket.

The FDA indicated that it was considering issuing an order requiring Philips to submit a plan for the repair, replacement, or refund of the purchase price of recalled devices manufactured after November 2015. Philips has said that it will provide a written response, but in the meantime, the FDA is waiting to issue an order.

It’s important to note that while waiting for the repair or replacement of your Philips CPAP device, you should not stop using it until you speak with your doctor. He or she may suggest alternative treatments for your sleep apnea, such as lifestyle changes, nasal decongestants, weight loss, or sleep apnea surgery. These alternatives can help alleviate the symptoms of sleep apnea while you wait for a resolution to the recall issue.

Filing a Lawsuit Against Philips for Defective CPAP Devices

If you or a loved one has suffered medical problems as a result of exposure to the PE-PUR foam in a recalled Philips CPAP device, you may be eligible to recover compensation for the losses that you suffered. Victims of defective CPAP devices can file a lawsuit against Philips to hold the company accountable for its actions and seek compensation for their damages, which may include medical care, lost wages, and the cost of a replacement device.

It’s important to act quickly if you believe that you are eligible for litigation. There is a limited amount of time to file these claims, and if you miss the filing deadline, your case will likely be dismissed. In these situations, you need a Philips CPAP recall attorney on your side who can explain your legal rights and help you file a lawsuit.

An attorney can support your case in several ways, such as:

  • Gathering evidence to support your claim for compensation
  • Building a strong case to present in court
  • Navigating the complex legal system and filing your lawsuit
  • Representing you in court and negotiating settlements on your behalf
